Tenant Safety – Principal and Property Manager’s Risk


It is the clear responsibility of both the Landlord and the Property Manager to ensure that the Tenant is provided with a safe property. If someone is hurt or suffers loss, they will seek and have been seeking compensation from both the Landlord and Property Manager. The Landlord’s defence may well be “I was paying a professional property manager to look after the property, so it was their responsibility!” Whilst there are defence arguments that could be raised against this, the courts have demonstrated that, usually, the claim is apportioned between the agent and the Landlord, with the majority of it going towards the agent, especially if any negligence could be demonstrated. This perceived negligence can be as simple as the property manager did not know about an issue or was not experienced enough to identify it or merely that they failed to remind the Landlord of the issue.

Irrespective, whether the agent was or was not contributory to the injury, one thing is certain, being that they will need to spend a very significant amount of time and cost preparing for and defending their actions. If they lose, then the situation moves to a totally different level regarding the magnitude of the claim and their ability to meet that claim. Successful claims have put agents out of business. This is always a reality with some successful personal injury claims have been awarded up to $30M in damages over recent years.

Property inspections are core to this, with you collating information for the Landlord to assess and act upon.
